A Toast to Champagne™

Happy New Year! As we say so long to 2015 and hello to 2016, many will be toasting with champagne. To celebrate the festivities, we have some wine trivia for your New Year’s Eve party. Champagne has a rich history that’s bubbled up in intellectual property law, and been decanted into a trademark. Champagne is a geographical trademark of the Champagne region of France, so for a wine to be a “champagne,” its grapes must be grown in the Champagne area of France. Trademarks guarantee consumers they are getting a genuine product or service – your favorite brands are likely trademarked. The French call sparkling wines from other regions of France Mousseux or Crémant. Among many other virtues, the French have long been excellent vintners. Many New Year’s Eve revelers enjoy sparkling wines from other countries or from America (especially California). Many sparkling wines are labeled Méthode Champenoise, French for champagne method. Hearkening back to geometry class, just as every square is a rectangle, but not every rectangle is a square, so every bottle of champagne is made in the Method Champenoise, but only bottles from Champagne, France are truly champagne. (Think of Kansas City BBQ vis-a-vis BBQ in the Kansas City style.) What’s your favorite champagne or sparkling wine to celebrate with? Trademarks 101

Trademarks come in three flavors: state, federal, and international. A trademark is legal protection for the continuous use of a mark (slogan, logo, etc) in commerce within a particular industry or business. The most common trademarks (which also have the best protection) are federal trademarks, granted upon application and negotiation with the U.S. Patent & Trademark Office. An often overlooked trademark (which is less expensive and provides more local protection) is a state trademark – granted in both Kansas and Missouri. And treaties and other legal systems protect trademark rights internationally too. When your business or nonprofit’s distinctiveness and reputation depends on using a mark, slogan, logo, or other insignia, you need a trademark. And you need an experienced trademark attorney who understands the application and negotiation process and has a proven track record of helping clients get trademark protection.

Copyright 101

Copyrights protect expressions of ideas. Many things can be copyrighted: blog posts, websites, books, photos, videos, and so forth. As a creator, you have a copyright in whatever you write or create from the moment of creation, but you need to register your copyright with the Library of Congress to protect your rights (including enforce your copyright in court). If someone copies your work, distributes or sells or licenses it without your permission (and paying you), they’ve committed copyright infringement. You can sue them in court and get civil damages, get them to stop (an injunction), vindicate your copyright (with a declaratory judgment), and an infringer or pirate can also be liable criminally (the FBI and Interpol warnings at the start of each DVD). But to manage and protect your IP rights, you need a good copyright lawyer with experience who knows the copyright and IP landscape. I work with content creators to copyright their IP, as well as to manage IP rights, and defend clients’ copyrights from piracy and infringement online and in other forms.
